In North Carolina, the impact of the NAR lawsuit with the Department of Justice is minimal. As an attorney state, North Carolina operates differently from title states, with real estate documents drafted by the North Carolina Bar Association and approved by the North Carolina Real Estate Association. North Carolina has been practicing buyer agency agreements since 1995, and the state’s listing agreements have always clearly indicated that the seller pays the commission to the listing agent, who then compensates the buyer agent and their firm.

However, there will be some changes in transparency. The commission that the seller negotiates with their listing agent, and whether they agree to pay a buyer agent on behalf of the buyer, will now require more open communication. While this might add a few extra steps to the process, it’s nothing that can’t be handled with a conversation between you and your buyer agent.
